There is currently an appeal pending in this matter before the United States Court of Appeals for the Eleventh Circuit.  The distribution of the Settlement Fund to eligible Class Members cannot proceed until this appeal has been resolved.

What is the Settlement about?

A Settlement has been reached in a class action lawsuit with Public Storage involving the sale of self-storage insurance at Public Storage. The Class alleges that Public Storage deceived its Florida tenants by representing it would send the premiums collected through the sale of self-storage insurance to an independent insurance company but that Public Storage actually retained more than 75% of the premiums paid by its Florida tenants.  Public Storage denies that it said or did anything unfair or deceptive, asserts that tenants got the full benefit of their bargain, and asserts that it fully complied with all applicable laws. The Court has not decided which side is right. This lawsuit and Settlement do not impact your insurance coverage or insurance claims.


Who is included in the Class?

The Settlement Class consists of all persons who rented storage units from Public Storage within the state of Florida and who purchased self-storage insurance policies through Public Storage from May 1, 2010 through June 18, 2015. Excluded from this Class are Public Storage, its affiliates, subsidiaries, agents, board members, directors, officers, and/or employees.

If you are a member of the Settlement Class, your legal rights are affected and you have a choice to make now:



The deadline to file a Claim has passed as of January 11, 2016.




The deadline to submit a request to be excluded from the Class has passed as of January 11, 2016.




The deadline to object to the Settlement has passed as of January 11, 2016.




If you do nothing, you are and will remain a member of the Settlement Class, however, in order to receive compensation from the Settlement Fund, you must file a claim.

These attorneys will represent you as part of the Settlement Class unless you choose to hire your own attorney.  You have the right to hire your own attorney at your own expense.  Settlement Class Counsel represents the Settlement Class on a contingency basis and payment to Settlement Class Counsel for their attorneys’ fees and costs must be approved by the Court and will be deducted from the Settlement Fund.

Settlement Class Counsel may seek to request up to 35% of the money in the Settlement Fund for attorneys’ fees, plus reimbursement of their documented expenses incurred in connection with prosecuting this Lawsuit.  However, Public Storage will object to Settlement Class Counsel’s request for any fee award that exceeds 25% of the Settlement Fund. The Court will determine the amount of attorneys’ fees and expenses to award Settlement Class Counsel.  The fees and expenses awarded by the Court will be paid out of the Settlement Fund.  Settlement Class Counsel will also request that $10,000 be paid from the Settlement Fund to Plaintiff Brian Morgan, in addition to the relief that he is entitled to under the Settlement, to compensate him for his service to the entire Settlement Class.
